Why did Roosevelt need a second bill of rights to pass healthcare and Obama did not?

Roosevelt could not pass health care reform with out the second bill of rights because it was unconstitutional, but now we passed it without it? Hmmm seems to me unconstitutional then unconstitutional now. When will we send this to the supreme court to be thrown out?
